Prague – The Czech Chamber of Authorized Engineers and Technicians Active in Construction (ČKAIT) will ask the government for the possibility to submit not only applications electronically, but also documentation required in the building process. According to the current form of the amendment proposal allowing the simultaneous use of new and original building administration systems, documentation will still have to be submitted through the Builder's Portal. However, this significantly prolongs and complicates the work for builders and designers due to the poor functionality of the portal, ČKAIT claims in a press release available to ČTK.
With the new digitized building administration systems launched on July 1, officials and builders have been facing problems from the very beginning. Minister of Transport Martin Kupka (ODS), temporarily authorized to coordinate the further development of building administration, previously stated that he would allow the parallel use of original and new systems. The solution to the so-called 'legislative bypass' and other solutions will be presented to the government next week - on October 16.
According to the preliminary draft amendment, officials will not have to process applications in the new Information System for Building Administration; they will be able to handle all the work in a different functional environment. In contrast, builders will still have to upload the necessary documentation to the Builder's Portal. Applications can subsequently be submitted in paper form, such as via data boxes, but they must include a link to the location of the documentation on the portal. According to ČKAIT, this will simplify work only for the officials, not for the builders, who are struggling with similar problems with the new systems.
"Submitting an application is now more labor-intensive, it takes longer, and raises the cost of project documentation. Builders and officials are mostly lost in the Builder's Portal. Therefore, during the transitional period, it should be up to the builder to decide whether to use this system or submit a paper application along with the project documentation. Once the Portal functions as it should, builders will want to use it voluntarily. No one wants to return to bundles of paper documentation," said ČKAIT Vice Chairman František Konečný.
According to the chamber's chairman Robert Špalek, simplifying work should not be limited to officials in building offices only. "The transitional period must apply to everyone. It is not possible to discriminate against builders who did not have sufficient time to adapt to the requirements of new implementing regulations issued only this May and June," he added.
In addition to establishing a transitional period for the use of the Portal by builders, the chamber also wants to quickly revise all existing transitional provisions of the new building law and amend the regulation on building documentation. ČKAIT demands that the deadline for completing buildings according to documentation processed under earlier regulations be extended. The regulation on building documentation uses different terminology than the new building law and deviates from the practice of some concerned authorities. The document was supposed to simplify and expedite the permitting process, but it has not fulfilled this yet.
