Brno - The preliminary injunction prohibiting Brno from managing the land of the Jaselské Barracks remains in effect and is valid, ruled the Regional Court in Brno. The court sided with the firm Kliminvest, which acquired the land through a contract in 2007 and was to ensure the redevelopment of the site into apartments, shops, and offices. However, it did not begin redevelopment within the contractual deadline, only demolishing the old buildings, which is why the city terminated the contract in 2009. The company informed about the court's decision today in a press release.
So far, the court has made a definitive ruling only on the preliminary injunction. The validity or invalidity of the termination will be decided further. The city is thus unable to manage the land, and it is evident that any construction between Štefánikova and Střední streets is being postponed again. The city unsuccessfully attempted to reach an out-of-court settlement with the firm. The city’s statement is being sought by ČTK.
Kliminvest is also suing the city for damages amounting to 360 million Czech koruna, which, with penalties, reaches 480 million, and the penalties are set to increase by 40 million each year.
In previous months, the city had been preparing a partial change to the zoning plan to allow for the construction of more apartments instead of the originally planned larger number of shops and offices.
The former Jaselské Barracks were the filming location for the series Četnické humoresky. Since the demolition of the buildings, the site has become overgrown with wild vegetation and remains unmaintained.
