Prague, December 21 (ČTK) - The government today approved a proposal for an amendment to the building law, which is aimed, for example, at changing the position of the public in the building process. ČTK was informed about this by a source from the government meeting. People will be able to comment on draft zoning plans at a stage in the administrative process that was not previously possible. The change is also intended to strengthen the position of owners of land affected by the zoning plan. So far, only owners of land and buildings affected by the proposed public benefit buildings, public benefit measures, and developable areas can raise objections to the planned zoning plans. From now on, all owners of land and buildings affected by the proposed solution of the zoning plan will be able to raise objections. The proposal to amend the building law was prepared by the Ministry for Regional Development (MMR). Some changes proposed in the original version were not liked by the Government Legislative Council. Comments from legal experts mainly concerned the position of the public in the building process. The Ministry of Regional Development subsequently revised the draft amendment. "The fact remains that issues regarding the impact of future buildings on the environment will primarily be assessed in the zoning proceedings, considering that it is in this proceeding that it is defined what kind of building it is, its size, purpose, and so on. And in this proceeding, the possibility of public participation is fundamentally strengthened," said Deputy Minister for Regional Development Miroslav Kalous on Tuesday. The Government Legislative Council also pushed for a change in the position of authorized inspectors in the proposal. Their decisions can replace traditional building proceedings. "It is newly proposed that a certificate issued by an authorized inspector be published on the official board of the building authority at the site of the building for 30 days, and that during the following 15 days, there will be an opportunity to submit any objections against the issued certificate by those persons who would otherwise be participants in the building proceedings if they were held," Kalous informed. According to MMR, the purpose of the amendment to the law is to remove the shortcomings of the current norm and to gradually deregulate the area of building law. The goal is to accelerate, simplify, and reduce the cost of preparing and approving constructions by expanding the scope of constructions that do not require a zoning decision or building permit.
