The court ordered to list studio M1 as the authors of the design of the hall in Brno


Brno - The creators of the original design of the concert hall in Brno from the M1 architects studio have achieved a partial success; the court ordered them to be credited as the authors of the architectural and urban work in a document describing the connection of construction phases. The Regional Court in Brno thus granted the request for a preliminary injunction, which is part of the filed lawsuit for protection against infringement of copyright. Pavel Joba from M1 studios told ČTK today, and ČTK is verifying the court's and the city's statement.

Brno spokesperson Filip Poňuchálek, when asked about the court's decision, simply stated that the city had received the lawsuit, the management is now familiarizing itself with it, and it is said to express its position on Tuesday.

M1 studio criticizes the current situation, where an international design team led by Polish architect Tomasz Konior has continued from the original design. According to the new design, the building is intended to be bulkier than the valid zoning decision allows, among other differences. The lawsuit is directed against the city of Brno, the city joint-stock company Brněnské komunikace, Konior's studio, and the cooperating Brno studio Architekti Hrůša a spol.

"Please ensure the return of the Janáček Cultural Center project back to implementable tracks in accordance with the valid zoning decision, so that we all see the completion of the building by the end of 2020, as you planned, and not another decade of delays and wasted effort,"
stated M1 studio in an open letter to Mayor Petr Vokřál (ANO).

"For the city, the primary goal is to ensure that the new hall is at the highest technical level. Once the entire project is completed, we will intervene with all relevant authorities. I believe that negotiations with the authorities will be within the law, correct, and accommodating," Vokřál stated earlier in response to objections regarding the new form of the project.

According to the lawsuit, the new team of architects deviated so much from the original design that it resulted in a change of the author's work without the authors' consent.

The city officially presented the new architectural concept on September 14. Konior's team proposed a hall with a capacity of 1,300 people and a stage that can accommodate even the largest orchestral and choral ensembles. A characteristic feature of the concept is duality. The building unites two structures in one building. One is massive, consisting of the hall and the orchestra's facilities, while the other is glazed and open, intended for visitors.

The Ministry of Culture is prepared to co-finance the hall between Besední and Veselá streets with an amount of 600 million crowns. The total costs may reach up to 1.5 billion crowns. The underground garages are completed but are not yet in operation.
