Hradec Králové - According to the verdict of the Regional Court in Hradec Králové, a twenty-meter protective zone around a solar power plant must lie within its premises and thus be part of it. This groundbreaking interpretation of a section of the energy law would effectively reduce the capacity of power plants, Czech Television reported today.
"It is appropriate to release a space of 20 meters around the entire perimeter of the construction site where the panels are located," the regional court's interpretation states.
The vast majority of photovoltaic power plants, however, have the protective zone outside their premises. "I have not encountered this interpretation (of the court) yet. It would definitely be a problem if this interpretation were to apply, let's say, retroactively to those already installed," said Tomáš Baroch from the Czech Photovoltaic Association to Czech Television.
The Energy Regulatory Office (ERÚ) is currently monitoring 180 solar power plants. They have already checked 30 of them, and not one was completely in order; 28 of them have serious issues. Inspectors are also paying attention to the protective zones. "In our practice so far, we have mostly looked outside the fence, but that is more of a feeling; we cannot comment on the court's decision," said ERÚ spokesman Jiří Chvojka to Czech Television.
