Brno - Brno will file a lawsuit against the company Czechcity to determine ownership rights regarding the roads on the land around the stadium Za Lužánkami. Ownership will thus be decided by the court. This was announced today at a press conference by the city mayor Markéta Vaňková (ODS). Czechcity is one of the companies owned by businessman Libor Procházka. The entrepreneur claims that the properties on the respective land are his and has previously sent the city pre-litigation reminders over alleged unjust enrichment for using these buildings. The disputes are preventing the construction of a new football stadium.
Deputy Mayor Tomáš Koláčný (Pirates) believes that a final court decision in this matter may take several years.
"This is a declaratory lawsuit. The aim of this lawsuit is for the court to decide who is the owner of the relevant buildings on land owned by the city," Vaňková stated. According to her, the last pre-litigation demand was for the amount of 19 million crowns. However, the council decided that the city would not pay this amount.
In the Ponava area, according to Deputy Koláčný, there are currently four building proceedings underway, two concerning the modernization of the football stadium, one on Sportovní street, and the other on Drobného street. The building office has urged both parties to file a lawsuit to determine ownership in all four cases. "These properties have historically been associated with the land to ensure service to the stadium. The city has never transferred these properties to any entity; they are part of the land," Koláčný stated.
Procházka owns, for example, underground garages and a tennis hall in the area. The businessman does not want money for them, but other properties. However, negotiations about the exchange have stalled due to the resistance of residents and some politicians. In the past, the city lost a court case against Procházka regarding the use of the garage roofs, settling out of court by paying 13 million crowns.
Zbrojovka previously won a title at the stadium Za Lužánkami, but since the beginning of the millennium, the building has been deteriorating. The city wants to build a new stadium with 30,000 seats for two billion crowns.
