Prague - According to the leadership of Prague 1, there is no legal reason to appeal against the construction of a house nicknamed marshmallow, which is set to be built near the Agnes Monastery. Today, the city council merely took note of the protests from hundreds of people from last week. There is already a zoning decision for the controversial building, which the investor has been negotiating for 17 years, and last December the company applied for a building permit. Opponents of the construction refer to the negative stance of the Ministry of Culture and comments from the National Heritage Institute (NPÚ), while the local authorities rely on the approval of city heritage officials.

    According to Mayor Oldřich Lomecký (TOP 09), the city council cannot interfere with the powers of the construction department when issuing building permits. However, it can appeal as a party to the proceedings. "We have appealed in this way many times before. But for example, due to a specific material objection that we raised in the past and was not resolved. Just appealing because we don't like something is merely a populist-declarative step," the mayor said.
    However, critics of the building disagree with the assertion that there are no grounds for an appeal. Vítězslav Praks from the Civic Monitoring stated that the law is not being followed. According to him, for example, the invitations to the parties involved were poorly delivered, or the NPÚ's stance, which was initially negative, was changed. Additionally, the published intention did not cover all the land where construction is set to take place, which is why they consider the contract to be invalid.
    "Every new building in a historic city has problems. That is normal," said Francesco Augusto Razetto, managing director of Praga Progetti e Investimenti, today before the councilors. However, according to him, the company has always acted in accordance with the law and has obtained all necessary permits thus far.
    Opposition to the construction was also voiced at a recent demonstration by Deputy Mayor Matěj Stropnický (SZ/Trojkoalice) and Culture Councilor Jan Wolf (KDU-ČSL/Trojkoalice).
    The Prague City Hall not only issued a statement regarding heritage protection, but also owns part of the land where construction will take place. It has a contract with the investor for its future sale. According to this contract, Prague is supposed to sell the land to the investor as soon as the construction is completed. In total, the buyer is expected to pay about 28 million crowns, which the critics claim is an unreasonably low price. The investor argues that the price corresponds to the 1990s when the contract was concluded.
    Developers want to build a residential building with six above-ground floors, a flat roof, and underground garages next to the monument from the first half of the 13th century in the Prague Heritage Reserve in the Old Town. The façade with windows and balconies grouped in the shape of "smileys" was initially to be in pink and white, which is why people began calling it marshmallow after similarly colored marshmallow candies; later, the investor conceded and plans to use muted gray tones. There used to be a residential building on the plot that was bombed during World War II.
