Prague - The company Vítězné náměstí has filed a cassation complaint against the ruling by the municipal court in Prague that recently annulled the amendment to the zoning plan regarding the Polar Bear project at Vítězné náměstí in Prague 6. The investor is asking the Supreme Administrative Court (NSS) to annul the ruling and return it to the municipal court for a new hearing. The Polar Bear originally obtained an exemption from the zoning plan. The construction would not fit into the restrictions that apply to Vítězné náměstí due to its planned scope. Two residents from surrounding properties filed a lawsuit against the granting of the exemption, and the court ruled in their favor. "The court did not take into account that the Polar Bear project actually went through a discussion with the relevant authorities and the public, as part of the proper zoning process," Beneš argues on behalf of the investor. The developer also requested the municipality to suspend the zoning procedure until April 30 of next year. Although the municipality issued the zoning decision last November, it has not yet taken effect. They were waiting for the court's decision. According to the opposition, the office has reopened the debate on whether the construction should even take place in the square. The placement of the building in Dejvice has been discussed for several months. The design by architect Radan Hubička evokes mixed reactions from the public and professionals, as is often the case with unconventional architecture. The multifunctional building is intended to complete the currently open block of houses, thereby fundamentally changing the appearance of the square. The investor states that the construction will provide new services for the residents in addition to administrative spaces. Last year, the design was awarded as the best architectural project in the renowned Building of the Year competition. The opposition and civic associations criticize the coalition for past decisions regarding the municipal land, where the town hall decided, in collaboration with a private investor, to build a commercial building instead of the previously planned town hall building. Ultimately, Prague 6 gave up participation in the project. However, the investor of the Polar Bear retained the preemptive right to the land.
