Brno - The company Office Park Šantovka was unsuccessful in its legal dispute with the National Heritage Institute (NPÚ). The company was dissatisfied with how the institute expressed its negative stance towards the intention of the Šantovka Tower high-rise building in Olomouc. The lawsuit was dismissed last year by the Municipal Court in Prague. The subsequent cassation complaint was resolved similarly by the Supreme Administrative Court on Wednesday, as reported by ČTK from the official board. The court has not yet published its reasoning. The company claimed in the lawsuit that NPÚ was exerting unlawful pressure on Olomouc's city heritage officials. The company wanted the Municipal Court in Prague to prohibit the institute from issuing press releases and other statements regarding Šantovka Tower, as well as holding press conferences and other similar activities. However, the Municipal Court did not find grounds for such intervention. The Scientific Council of NPÚ deemed the high-rise building proposal unacceptable from a heritage conservation standpoint in 2013. The institute publicized the Scientific Council's stance shortly before the first decision-making by heritage officials from the city. Despite this, the city issued consent for the project twice. However, those decisions were always annulled by the Regional Office of the Olomouc Region. Most recently, in February of this year, the regional office stated that the position of the city was ambiguous and unclear, and therefore also illegal. According to the regional office, the city heritage officials ignored the statements of the NPÚ's Scientific Council. Furthermore, they did not proceed according to the law on state heritage conservation when they did not assess the impact of the construction on the urban heritage reserve. The officials reportedly only took into account the uniqueness of the new building, the quality of architecture, and its relationship to the yet non-existent new district. Šantovka Tower, with its 75 meters, would share the position of the second tallest building in Olomouc with the town hall. Due to the project, the developer company Office Park Šantovka also sued the town hall. The new zoning plan, in fact, prevented the construction of the high-rise building and other buildings in its vicinity. At the end of February, the court annulled the height regulation in this part of Olomouc. However, the town hall was given time until the end of this year to justify the height regulation again and better.
