The definition of the heritage zone in Brno-Kralovo Pole has stood up in court

Brno - The designation of the heritage conservation area in Brno-Královo Pole has definitively withstood scrutiny by the administrative courts. The Supreme Administrative Court (NSS) rejected the appeal of the city of Brno, as reported today by ČTK from the official bulletin. The city wanted the courts to annul the measure. It considered the zone to be too broadly defined, citing also the vagueness of the measure and its potential impacts on construction.

The Ministry of Culture declared the historically and urbanistically most significant parts of Královo Pole a heritage conservation area at the suggestion of the National Heritage Institute. The general measure came into effect in November 2022.

The city of Brno turned to the Municipal Court in Prague, which rejected the proposal to annul the measure. The NSS made a brief reference to the conclusions of the municipal court in its decision.

The Municipal Court supposedly addressed the impact on urban development adequately. "It concluded that the challenged general measure does not establish any prohibitions. It only stipulates an obligation for certain projects to be assessed by the heritage protection authority within the framework of a binding opinion," states the NSS decision.

City leadership previously assured that it considers the protection of heritage sites necessary. However, it regarded the declared zones as overly extensive. They reportedly include properties and streets that do not require protection, thereby disproportionately infringing on the rights of property owners.

At the beginning of 2023, the Ministry of Culture also approved the form of the long-prepared Heritage Conservation Area Brno, which encompasses the broader city center, part of Žabovřesky, and the city district Brno-North. In this case as well, Brno unsuccessfully turned to the Municipal Court in Prague and then to the NSS, which, according to available information, has not yet made a decision.
