Olomouc - Representatives of the Art Museum in Olomouc (MUO) are disputing with the Ministry of Culture about the validity of the dismissal of director Michal Soukup. According to them, it is invalid because the decision of the Minister of Culture Antonín Staněk (ČSSD) from April 18 has not yet been personally received by the director. They refer to the interpretation of lawyers. The museum's spokesperson Tomáš Kasal told ČTK today. However, representatives of the Ministry of Culture reject this, stating that the dismissal becomes effective ten days after delivery.


"In the case of the dismissal of Michal Soukup from the position of director of the Art Museum Olomouc and the appointment of "temporary administrator" MUO Ondřej Zatloukal, there was a chain of legal errors. This follows from a legal analysis prepared by the Prague law firm Vepřek, Caska, Vlachová," said the museum's spokesperson.

He points to the lawyers' assertion that the dismissal according to the labor code cannot be carried out with immediate effect, as the Minister of Culture did, but is effective only upon delivery to the dismissed employee. "According to the labor code, the dismissal must then be delivered to the employee's hands, at their workplace, at their residence, or anywhere they can be reached, which has not yet happened. Thus, the dismissal cannot be considered effective until it is delivered to Mr. Michal Soukup," Kasal stated.

According to the Ministry, however, the dismissal of the director from office is valid. "The dismissal of the director of the Art Museum Michal Soukup was properly sent through postal services, and if Mr. Soukup does not receive it, the effect of delivery occurs even after ten days, thus taking effect. It is therefore not true that the dismissal by the Minister of Culture is legally invalid," said the spokesperson
